Welcome to sellerbd.com. These Terms & Conditions ("T&C") form a legally binding agreement between you (users, buyers, and sellers) and FAIR GROUP, operating as sellerbd, website: sellerbd.com (hereinafter referred to as “the Platform”, “we”, “our”, “us”).

By accessing or using this platform, you agree to be legally bound by these Terms & Conditions. If you do not agree, please discontinue using the website immediately.

⚠️ Legal Notice: In case of any legal dispute, the Bangla version of this document shall be considered final and authoritative.

1. Acceptance of Agreement

1.1 Binding Consent

By using sellerbd.com, you confirm that you have read, understood, and agreed to these Terms. This constitutes a valid contract under the Contract Act, 1872.

1.2 Platform Role

sellerbd.com acts solely as an online marketplace (facilitator) between buyers and sellers.

We are not the manufacturer, supplier, or owner of listed products.

All responsibility regarding:

  1. Product quality
  2. Authenticity
  3. Delivery
  4. Warranty
  5. Legal compliance (including Consumer Rights Protection Act, 2009)

rests entirely with the seller/vendor.

2. Vendor Legal Obligations

2.1 Mandatory Legal Information

Vendors must clearly display the following on their digital storefront (as per Digital Commerce Guidelines 2021):

  1. Trade License Number
  2. TIN Number
  3. VAT Registration Number
  4. UBIN or Personal Retail Account (PRA), if applicable

2.2 Prohibited Business Activities

The following are strictly forbidden:

  1. Consumer rights violations
  2. MLM / Network marketing
  3. Online gambling or betting
  4. Unauthorized lotteries or raffles
  5. Explosives, narcotics, illegal items
  6. Sale of medicines/medical equipment without license

Violation will result in immediate account termination and possible legal action.

2.3 Product Authenticity & Misrepresentation

Sellers must ensure:

  1. Accurate product information
  2. Real pricing & stock
  3. Genuine reviews
  4. No fake discounts
  5. No misleading advertising

False advertising is a direct legal violation under the Consumer Rights Protection Act, 2009.

3. Payments, Escrow & Refund Policy

3.1 Advance Payment & Escrow

  1. All prepaid payments must be held in escrow accounts as per Bangladesh Bank regulations
  2. Funds will be released to sellers only after delivery confirmation
  3. If product is not “Ready to Ship” within 48 hours:
  4. Seller cannot take more than 10% advance without escrow

3.2 Refund Policy

  1. ✅ 100% Refund on approved refunds
  2. ❌ No processing fees
  3. ❌ No transaction charges to customers
  4. Refund must be sent via the same payment method
  5. No hidden COD charges allowed

4. Return & Cancellation Policy

4.1 Return Timeframe

Customers may request return within 14 days of delivery via website/app.

4.2 Return Conditions

Returned products must:

  1. Be unused
  2. In original packaging
  3. With tags intact
  4. Have valid reason (defective, damaged, wrong item)

4.3 Non-Returnable Items

Not eligible for return (unless DOA or defective):

  1. Personal hygiene items (underwear, earrings, innerwear)
  2. Custom-made products
  3. Activated mobile phones
  4. Digital vouchers/services

5. Dispute Resolution & Indemnification

5.1 Internal Complaint Resolution (IGRM)

Disputes must first go through sellerbd’s internal resolution system.

Response time: within 7 working days

This reduces risk of DNCRP complaints.

5.2 Indemnification

Vendors must legally protect sellerbd.com from:

  1. False advertising claims
  2. Fraud cases
  3. Consumer rights violations
  4. DNCRP penalties

sellerbd has full right to recover penalties from vendor payouts.

5.3 Governing Law & Jurisdiction

These Terms are governed by the laws of Bangladesh.

Disputes may be resolved under Arbitration Act 2001.

Jurisdiction: Dhaka, Bangladesh

6. Data Privacy & Security

6.1 User Consent

Explicit consent will be taken via checkbox before collecting personal data, as per Digital Commerce Guidelines 2021.

6.2 Data Protection

sellerbd.com follows:

  1. Digital Security Act 2018
  2. Bangladesh Data Protection Laws
  3. All user data will be securely stored and processed under the Privacy Policy.
